An immigrant who came to America to work for a prominent European banking family in the late 1830s, he attained wealth and influence and his lifestyle was emblematic of the Gilded Age. Belmont arrived in New York while the city was still recovering from two disastrous events, the Great Fireà of 1835 which destroyed the financial district, and the Panic of 1837, a depression which had rocked the entire American economy. Setting himself up as a banker specializing in international trade, Belmont became prosperous within a few years. He also became deeply involved in civic affairs in New York City, and, after becoming anà American citizen, took a great interest in politics at the national level. After marrying the daughter of a prominent officer in the U.S. Navy, Belmont became known for entertaining at his mansion on lower Fifth Avenue. In 1853 he was appointed to a diplomatic post in the Netherlands by President Franklin Pierce. After returning to America he became a powerful figure in the Democratic Party on the eve of the Civil War. Though Belmont would never be elected to public office himself, and his political party generally remained out of power atà the national level, he still exerted considerable influence. Belmont was also known as a patron of the arts, and his intense interest in horse racing led to one of Americas most famous races, the Belmont Stakes, being named in his honor. Early Life August Belmont was born in Germany on December 8, 1816. His family was Jewish, and his father was a landowner. At the age of 14, August took a job working as an office assistant in the House of Rothschild, Europes most powerful bank. Performing menial tasks at first, Belmont learned the rudiments of banking. Eager to learn, he was promoted and sent to Italy to work at a branch of the Rothschild empire. While in Naples he spent time in museums and galleries and developed an enduringà love of art. In 1837, at the age of 20, Belmont was sent by the Rothschild firm to Cuba. When it became known that the United States had entered a severe financial crisis, Belmont traveled to New York City. A bank which handled Rothschild business in New York had failed in the Panic of 1837, and Belmont quickly set himself up to fill that void. His new firm, August Belmont and Company, was established with virtually no capital beyond his association with the House of Rothschild. But that was enough. Within a few years he was prosperous in his adopted hometown. And he was determined to make his mark in America. Society Figure For his first few years in New York City, Belmont was something of rogue. He enjoyed late nights at the theater. And in 1841 he reportedly fought a duel and was wounded. By the end of the 1840s Belmonts public image had changed. He came to be considered a respected Wall Street banker, and on November 7, 1849, he married Caroline Perry, the daughter of Commodore Matthew Perry, a prominent naval officer. The wedding, held in a fashionable church in Manhattan, seemed to establish Belmont as a figure in New York society. Belmont and his wife lived in a mansion onà lower Fifth Avenue where they entertained lavishly. During the four years that Belmont was posted to the Netherlands as an American diplomat he collected paintings, which he brought back to New York. His mansion became known as something of an art museum. By the late 1850s Belmont was exerting considerable influence on the Democratic Party. As the issue of slavery threatened to split the nation, he counseled compromise. Though he was opposed to slavery in principle, he was also offended by the abolition movement.à Political Influence Belmont chaired the Democratic National Convention held in Charleston, South Carolina, in 1860. The Democratic Party split afterward, and Abraham Lincoln, the Republican Party candidate, won the election of 1860. Belmont, in various letters written in 1860, pleaded with friends in the South to block the move toward secession. In a letter from late 1860 quoted by the New York Times in his obituary, Belmont had written to a friend in Charleston, South Carolina, The idea of separate confederacies living in peace and prosperity on this continent after a dissolution of the Union is too preposterous to be entertained by any man of sound sense and the slightest knowledge of history. Secession means civil war to be followed by a total disintegration of the whole fabric, after endless sacrifices of blood and treasure. When war came, Belmont supported the Union vigorously. And while he was not a supporter of the Lincoln administration, he and Lincoln did exchange letters during the Civil War. It is believed that Belmont used his influence with European banks to prevent investment in the Confederacy during the war. Belmont continued to have some political involvement in the years following the Civil War, but with the Democratic Party generally out of power, his political influence waned. Yetà he remained very active on the New York social scene and became a respected patron of the arts as well as a supporter of his favorite sport, horse racing. The Belmont Stakes, one of the legs of thoroughbred racings annual Triple Crown, is named for Belmont. He financed the race beginning in 1867. Gilded Age Character In the later decades of the 19th century Belmont becameà one of the characters who defined the Gilded Age in New York City. The opulence of his house, and the cost of his entertaining, were often the subject of gossip and mentions in newspapers. Belmont was said to keep one of the finest wine cellars in America, and his art collection was considered noteworthy. In the Edith Wharton novel The Age of Innocence, which was later made into a film by Martin Scorsese, the character of Julius Beaufort was based on Belmont. While attending a horse show at Madison Square Garden in November 1890 Belmont caught a cold which turned into pneumonia. He died in his Fifth Avenue mansion on November 24, 1890. Consideration is something of value that is provided by both parties (Bagley, 2012). Lastly, a valid contract requires that both parties have the capacity to enter into the agreement (Bagley, 2012. Next I will discuss the duty of god faith and fair dealingà in the consumer/banking relationship. Prior to 1929, Massachusetts expressly provided that good faith was applicable to all contracts. In 1929, the Supreme Judicial Court, in addressing a breach of contract claim under an option agreement for the purchase of stock in an oil-producing leasehold, expressly stated, for the first time, that there was an obligation of good faith and fair dealing in all contracts. The court emphasized that a business contract ââ¬Å"is to be interpreted as a business transaction entered into by practical men to accomplish an honest and straightforward endâ⬠. The next topic is to compare and contrast the differences between intentional and negligent tort actions. There are several types of intentional torts and they are: torts against persons, intentional torts that involve personal property, and intentional torts with regard to economic interest and business relationships. There are also several types of negligent torts. Two of which are: duty to rescue and duty to invitees. Intentional torts against consist of battery, assault, false imprisonment, intentional infliction of emotional distress, defamation, and invasion of privacy. The key word in all of these intentional torts is intent or purpose to cause harm to another. Intentional torts against property include trespass of land, nuisance, conversion, and trespass to personal property. Intent and purpose are also why these are considered intentional. The key difference between these two torts is that one is against people and the other is a misuse of anotherââ¬â¢s property. An individual has to purpose commit these acts. Negligent torts consist of different types of duties. Duty is when a person with a legal duty to another is required to act, reasonably, under the circumstances to avoid harming the other person. Some examples of this are duty to rescue and duty to invitees. Duties are basically an obligation that one person is legally bound to perform for another. In comparing the two types of torts we find that intentional torts are torts that people commit against other people. Negligence also others but it is a failure to perform that causes the injury or unjust action. Anà example of this comparison is the intentional tort of battery and failure to perform the duty to rescue. When I commit battery I cause harm to another, when I fail to perform the duty to rescue the other individual also suffers harm but it is because I failed to act. In contrast intentional torts are actions committed against another and negligence is when I fail to take action on another. Next I will discuss the tort action of ââ¬Å"interference with contractual relations and participating in a breach of fiduciary dutyâ⬠. Interference with contractual relations protects the right to enjoy the benefits of legal ly binding agreements. It provides a remedy when the defendant intentionally induces another person to breach a contract with a plaintiff. Interference with contractual relations requires intent to interfere. The existence of a contract is the difference between tortuous interference and the more difficult to prove tortuous interference with prospective contractual relations. The most famous case of tortuous interference was Pennzoil v Texaco which occurred in 1983 (Bagley, 2013). Similarly a defendant who knowingly participates in, or induces a breach of fiduciary duty by another commits the tort of participation in a breach of fiduciary duty. Lastly, I believe that if god grounds exist for the interference, such as exists in the JPMorgan Chase case then I should be able to prevail in the tort action. Lastly, I will cover how banks protect the software that allows for online transactions. Most banks protect the customers who participate in online transactions through what is called the Online Banking Guarantee. This protection covers your banking and personal information. It is the banks responsibility to ensure the customers protection while the customer engages in online transactions. In most if not all case the customer is 100% covered in the case of theft of funds. One of main defenses for software protection is through complex encryption systems. Another deterrent is simply the vast amount of software that is available for online banking. So between the wide array of software and encryption systems online banking transaction are relatively safe. Sometimes, the grief is just too much to take that the marriage or relationship falls apart. Grief and sadness are genuine and real emotions. People feel these in real-life situations. The poem, ââ¬Å"Home Burialâ⬠by Robert Frost, highlights how death and the grief it causes ruins relationships. Tragedy creates barriers between people. Reader Response A reader of the poem would experience the grief and sadness in the poem. It talks about a family tragedy and grieving over the loss of a child. From my own reading, the poem gives description of the graves that further describe the theme and extends the ideas of what is happening. For example, the male character said: ââ¬Å"The wonder is I didnââ¬â¢t see at once. I never noticed it from here before. I must be wonted to it ââ¬â thatââ¬â¢s the reason. The little graveyard where my people are! So small the window frames the whole of it. (Lines 21-24) But I understand: it is not the stones, But the childââ¬â¢s moundââ¬ââ⬠(lines 30-31) This demonstrates that the poem is depicting a sad event that had occurred and where it is mentioning the clear idea of a tragedy. I personally feel that this poem best describe a couple grieving over a loss of their only child which makes them confused as to how to just move on back to their normal life. But also with the struggle of having arguments between them, it is clear that they both have problems. Just looking at one another brings up the grief that they both cannot seem to express and this makes the poem seem even sadder to read. New Criticism ââ¬â Plot The poem starts out with the narrator describing the two characters whose interaction becomes the center of the story. They speak of what they saw in the distance from a small window up above the second floor of the house. The story further continues with the two getting into a heated argument and despair over the loss of their child. An example of their argument is: ââ¬Å"There you go sneering now!â⬠ââ¬Å"Iââ¬â¢m not, Iââ¬â¢m not! You make me angry. Iââ¬â¢ll come down to you. à God, what a woman! And itââ¬â¢s come to this, à A man canââ¬â¢t speak of his own child thatââ¬â¢s dead.â⬠(Lines 72-75) As the woman attempts to leave the house, the tension between the characters heightens. The exchange of words is the climax of the plot. The denouement is reached as the woman finishes expressing her emotions. The end of the poem is signaled as the husband says: ââ¬Å"There, you have said it all and you feel better. You wonââ¬â¢t go now.à Youââ¬â¢re crying.à Close the door. The heartââ¬â¢s gone out of it: why keep it up? Amy!à Thereââ¬â¢s someone coming down the road!â⬠(Lines 112-115) The plot is very confrontational but also sad in a modern day view of a tragedy. It is very believable due to the realistic confrontation that is happening in the poem and how people usually react when they are in heated arguments between one another. New Criticism ââ¬â Character As the characters in the poem interact, their personalities, feelings, and emotions are revealed. As the poem moves along, readers get to know each of the characters better. The poem has five characters a Man (unknown), Woman (Amy), Narrator, Child (Baby), and a Person who is unknown coming toward the house.à They all seem to be in a universal role of connecting to each other throughout the turns of events thatââ¬â¢s occurring though each line of the poem. The characters are very realistic. The feelings they express and the manner by which they interact are common occurrences in real life. The realism is further revealed by the fact that the two main characters argue over something that is real, grief. In a way, their argument can be seen as a loversââ¬â¢ quarrel. For example: He said twice over before he knew himself. ââ¬Å"Canââ¬â¢t a man speak of his own child heââ¬â¢s lost?â⬠Not you! ââ¬â Oh, whereââ¬â¢s my hat? Oh, I donââ¬â¢t need it! I must get out of here. I must get air.ââ¬â I donââ¬â¢t know rightly whether any man can.â⬠ââ¬Å"Amy! Donââ¬â¢t go to someone else this time. Listen to me. I wonââ¬â¢t come down the stairs.â⬠(Lines 37-43) This demonstrates how the poem has a connection with a few characters of the poem and made the poem seem very believable in the understanding of a loverââ¬â¢s quarrel that is going on in the reading. In addition, the characterââ¬â¢s speech and the tone thatââ¬â¢s perceived from reading these lines make it feel like I am watching a live argument between a couple. This mainly shows that the reading and lines of these characters seem very believable in a notion of actually seeing this event occur in front of your very own understanding of the poem. New Criticism- Setting The realism of the poem is made more evident by the vividness of the setting. As one reads the poem, he would be able to create a picture of where the story takes place. Readers would get to see that the story is set in the late 1800ââ¬â¢s to the early 1900ââ¬â¢s in a two level house in the country side. There also seems to be a small graveyard that is around the back of the house which further explains that it is in the country side. The setting can be clearly pictured from the following lines of the poem: ââ¬Å"He saw her from the bottom of the stairs Before she saw him. She was starting downâ⬠(lines 1-2). ââ¬Å"The wonder is I didnââ¬â¢t see at once. I never noticed it from here before. I must be wonted to it ââ¬â thatââ¬â¢s the reason. These lines demonstrate that the setting is in a two story house and that the character is describing a small graveyard that can only happen in a country side background and not in a city. This setting enhances the realism of the story because it has been described and has been given a clear idea of the current background where the event of this poem is happening. But also, the way the characters talk sounds like old English and that further proves the idea that this poem is talking about a setting in the early 1900ââ¬â¢s.à So in a way, the poem has very clearly shown that the poemââ¬â¢s setting is happening in the past, and it is occurring in the country side. So in a way this has clearly shown that the setting is very believable in the description given in the poem. New Criticism- Universal Truth One of the few Universal Truthââ¬â¢s that I understand from the poem is that it grief and sadness can ruin relationships. When people, in this case couples, fail to express their emotions arguments arise. The lack of understanding and knowledge of what the other person needs causes tension which then leads to arguments. This is reasonable because in many relationships couples get into arguments to get to better understand the other persons needs and wants out of the relationship. For example, in the poem it, said: ââ¬Å"Canââ¬â¢t a man speak of his own child heââ¬â¢s lost?â⬠Not you!ââ¬âOh, whereââ¬â¢s my hat? Oh, I donââ¬â¢t need it! (Lines 36-37) Amy! (Line 111) This demonstrates how the poems Universal Truth is trying to show the idea that a couple can get into an argument and also understand each other by talking it out with each other. In addition, it also shows how the idea of Universal Truth is trying to convey to people in real life who have the same or similar situations like in the poem can always work things out. The resolution, however, can only come about when the feelings and emotions of both individuals are fully expressed. But this is a believable idea of Universal Truth that every couple can work out their differences by telling each other how they feel and what they think. Gender- Feminism An important theme that the poem tackles is gender. The poem highlights certain issues that are present between men and women. From a feministââ¬â¢s point of view, the poem is able to show that women have choices. Amy, the female character, has a choice to leave the man that she used to love. Amy has the freedom of choice and opportunity to leave her abusive relationship anytime. This is shown in the poem when the two are having a dispute: ââ¬Å"You ââ¬â oh, you think the talk is all I must go ââ¬â Somewhere out of this house. How can I make youââ¬ââ⬠à ââ¬Å"Ifââ¬âyouââ¬âdo!â⬠She was opening the door wider. ââ¬Å"Where do you mean to go? First tell me that. Iââ¬â¢ll follow and bring you back by force. I will!ââ¬ââ⬠(lines 116-120). This demonstrates the idea of Feminism when the character Amy wanted the choice to leave her sad and unhappy relationship. However, Amy also showed that she was in an abusive relationship that she is trying to run away from. But mainly Amy has shown that she will always have the opportunity to stand up for herself as an individual that has been oppressed by male dominance that is common in relationships. Gender- Masculinism Analyzing the poem from a masculinist perspective, it is evident that genuine concerns in relationships between men and women are shown. The male character is right for trying to talk to Amy about their problems as a couple. He tries his best to maintain his relationship as man who tries to understand Amyââ¬â¢s grieving over the loss of their child. His parents were two of the nicest people that I have ever met. They had a healthy marriage, good jobs, and a nice home. They always provided Rick with anything he needed or wanted. Rick had a girlfriend named Jamie and a lot of friends. He was also supposed to attend the University of Pittsburgh in the fall of 1997. Something was obviously missing in his life because it ended abruptly one night after a going away party for him. He went upstairs and took his best friend with him and pulled out a gun and shot himself in the head before his friend could figure out what was happening. He is a good example of a tragic life that was lost. In the story Paul's Case, Willa Cather shows that Paul is destroyed by a conflict with a hostile environment. To go along with that, many Confederate soldiers expressed the fear of being controlled by the North. This reaction, along with wanting self-government, seemed to be the main reason that kept the Confederateââ¬â¢s spirits high throughout most of the war, even in spite of the Unionââ¬â¢s military advantages. Many Southerners believing that they would have their own nation also lead to their high spirits. They were attempting to establish a new nation and were put down by Lincoln. As the Civil War went on, it soon became obvious to most that the Union could not be restored unless slavery, the cause of the conflict was abolished. With that, the objective for the war had been changed. The issue of slavery now mattered to Union Soldiers, especially after Abraham Lincoln issued his Emancipation Proclamation. This officially freed slaves that were being held in Confederate-controlled areas. Many people in the North opposed the emancipation, but during the second half of the war, many people began to change their minds when they realized that emancipation could affect Union morale in a positive way by supporting it, Instead of just fighting for the idea of ââ¬Å"saving the Unionâ⬠, the soldiers were now fighting for the cause of liberty as well. ââ¬Å"This was the first place on earth where the man mattered more than the state. True freedom had begun here and it would spread eventually over all the earth. But it had begun here. The fact of slavery upon this incredibly beautiful new clean earth was appalling, but more even than that was the horror of old Europe, the curse of nobility, which the South was transplanting to new soil. They were forming a new aristocracy, a new breed of glittering men, and Chamberlain had come to crush it. But he was fighting for the dignity of man and I that way he was fighting for himself. If men were equal in America, all the former Poles and English and Czechs and blacks, then they were equal everywhere, and there was really no such thing as foreigner; there were only free men and slaves. And so it was not even patriotism but a new faith. The Frenchman may fight for France, but the American fights for mankind, for freedom; for the people, not the land. (27) The cause of liberty, as defined by both sides, figured highly in the reasoning of many soldiers. Those of the North felt they were fighting to not only preserve the Union but to keep alive the spirit of the Declaration of Independence and of the Constitution. Lastly, and perhaps more pronounced as the War dragged on, the soldiers of both sides fought for each other. Many of us volunteered to fight for the Union. Some came mainly because we were bored at home and this looked like it might be fun. Some came because we were ashamed not to. Many came because it was the right thing to do. Soldiers on both sides believed that they were fighting for the same basic idea of liberty, but they interpreted it in completely different ways. People in the Union believed that the preservation of the U. S. government was most important, with natural rights of humans coming second. The Confederates, believed that the government was more a part of the problem than the solution, and that the solution (for the confederates) was to rebel. In their eyes they saw the North as tyrannical and controlling. Both sides also turned to nationalistic and patriotic ideas.
